Terms of Service

1. Services & Scope

Invincible Grace Luxury Epoxy & Stain, LLC provides professional concrete coating, epoxy flooring, polyaspartic systems, and decorative staining services to residential and commercial properties in Jacksonville, St. Augustine, Ponte Vedra, Nocatee, and surrounding areas of Northeast Florida.

All services are subject to availability. We reserve the right to decline any project request at our discretion, including but not limited to situations where site conditions are unsafe, the scope is outside our area of expertise, or the project location falls outside our service area.

Submitting a quote request through our website does not constitute a binding agreement. A project is only confirmed when both parties have signed a written service contract and any required deposit has been received.

2. Estimates & Pricing

All estimates provided — whether via our website form, phone, or in-person consultation — are non-binding until formalized in a signed written agreement. Estimates are based on information provided by the customer and conditions observable at the time of assessment.

Final pricing may be adjusted if:

• The actual square footage or scope differs materially from what was described
• The condition of the concrete surface requires additional preparation not identified during the initial assessment
• Customer-requested changes are made after the estimate is issued
• Material costs increase significantly between the estimate date and project start date

Written estimates are valid for 30 days from the date of issue unless otherwise specified.

3. Scheduling & Property Access

Customers are responsible for ensuring we have clear, safe, and timely access to the work area on the scheduled project date. This includes:

• Removing all vehicles, equipment, furniture, and personal items from the work area prior to our arrival
• Ensuring pets and children are kept away from the work area during installation and throughout the curing period
• Providing adequate ventilation for indoor work areas
• Notifying us in advance of any HOA restrictions, gate codes, or special access requirements

If we arrive at a scheduled appointment and cannot access the work area or conditions are not prepared as required, a trip fee may apply and the project may need to be rescheduled. Cancellations or rescheduling requests made less than 48 hours before the scheduled start time may result in a cancellation fee as outlined in your service agreement.

4. Payment Terms

Payment terms are established in the individual service agreement for each project. In general:

• A deposit is required to secure your project date; the amount will be specified in your service agreement
• The remaining balance is due upon completion of the project, prior to our departure from the property
• We accept Visa, Mastercard, American Express, personal check, cash, and ACH bank transfer
• Returned checks are subject to a returned check fee
• Accounts not paid within the agreed timeframe may be subject to a late payment fee and collection proceedings

All deposits are non-refundable once materials have been ordered or allocated to your project.

5. Warranty & Workmanship

We stand behind the quality of our work. Specific warranty terms — including duration and coverage — will be detailed in your written service agreement. Generally, our workmanship warranty covers defects in installation that arise under normal use and conditions.

The following conditions may void or limit warranty coverage:

• Failure to follow our post-installation care and maintenance instructions
• Use of incompatible cleaning products or chemicals on the coated surface
• Physical damage caused by impact, sharp objects, or heavy equipment not disclosed at the time of service
• Moisture or hydrostatic pressure issues that were present prior to installation and not disclosed
• Modifications to the coated surface made by anyone other than Invincible Grace

Our warranty covers workmanship only and does not extend to manufacturer defects in coating materials, which are subject to the manufacturer's own warranty.

6. Customer Responsibilities

To ensure the best possible outcome for your project, customers agree to:

• Provide accurate and complete information about the property and surface conditions when requesting a quote
• Disclose any known moisture issues, prior coatings, cracks, or structural concerns before work begins
• Follow all post-installation instructions provided by our team, including curing time requirements before vehicle or foot traffic is resumed
• Contact us promptly if any concerns arise with the completed work so we have the opportunity to address them

7. Limitation of Liability

Invincible Grace Luxury Epoxy & Stain, LLC's liability for any claim arising from our services is limited to the total amount paid by the customer for the specific project giving rise to the claim. We are not liable for:

• Pre-existing damage to the concrete surface, structure, or surrounding property
• Damage caused by conditions that were not disclosed or were not reasonably detectable at the time of our assessment
• Incidental, consequential, or indirect damages of any kind
• Loss of use of the property during the installation or curing period

Nothing in these Terms limits our liability for damages caused by our gross negligence or willful misconduct.

8. Website Use

By using this website you agree to use it only for lawful purposes and in a manner that does not infringe the rights of others. You agree not to:

• Submit false, misleading, or fraudulent information through the quote request form
• Attempt to scrape, copy, or reproduce website content without written permission
• Use the website in any way that could damage, disable, or impair its functionality

9. Governing Law & Disputes

These Terms and any disputes arising from your use of our website or services are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action shall be brought exclusively in the state or federal courts located in Duval County, Florida, and you consent to the personal jurisdiction of those courts.

Before initiating any formal legal proceedings, we encourage customers to contact us directly so we can work toward a fair resolution.

10. Changes to These Terms

We may update these Terms of Service from time to time. Any changes will be posted on this page with a revised effective date. Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
